9. RIGHT OF WITHDRAWAL

9.1. The Buyer who qualifies as a consumer within the meaning of art. 3, paragraph I, letter a) of the Consumer Code, has the right to withdraw from the contractual relationship with the Seller, without giving any reason and without having to bear any costs other than those described in point 9.5 below. The right of withdrawal may be exercised within the withdrawal period.

9.2. The withdrawal period ("Withdrawal Period") expires after 14 days have elapsed:

a) from the day on which the consumer or a third party, other than the carrier and designated by the consumer, acquires physical possession of the goods, or;

b) in the case of an order for multiple products delivered separately, from the day on which the consumer or a third party, other than the carrier and designated by the consumer, acquires physical possession of the last product;

c) in the case of delivery of a product consisting of multiple lots or pieces, from the day on which the consumer or a third party, other than the carrier and designated by the consumer, acquires physical possession of the last lot or piece.

The Buyer has exercised the right of withdrawal within the Withdrawal Period if the communication concerning the exercise of the aforementioned right is sent before the expiry of the Withdrawal Period.

9.3. How to exercise withdrawal. To exercise the right of withdrawal, the Buyer must inform the Seller, before the expiry of the Withdrawal Period, of their decision to withdraw. For this purpose, the Buyer may:

a) use the withdrawal form;

b) or submit any other explicit declaration of their decision to withdraw from the contract ("Withdrawal Declaration") indicating: order number, the product(s) for which they intend to exercise the right of withdrawal, and their address;

The Buyer who exercises the right of withdrawal is advised to use a durable medium that proves the sending of the withdrawal communication, since art. 54, final paragraph, of the Consumer Code places on them the burden of proof regarding the exercise of the right of withdrawal.

9.4. Return costs. The Buyer who has exercised the right of withdrawal must return the Product to the Seller at their own expense, using the carrier proposed by the latter or a carrier of their choice, without undue delay and in any case within fourteen days from the date on which they communicated their decision to withdraw from the contract. The deadline is met if the Buyer sends back the goods before the expiry of the period of fourteen calendar days.

The Buyer who exercises the right of withdrawal is liable for any diminished value of the products resulting from handling of the products other than that necessary to establish their nature, characteristics and functioning. In our case, where the protective film has been removed from the product or the product shows signs of use, the refund will be made net of the diminished value of the product.

9.5. Product return procedure. The Product must be kept, handled and inspected with normal diligence and returned intact, complete in all its parts, perfectly functioning, accompanied by all accessories and instruction sheets, tags, labels, protective films still attached and original packaging; the product must still be suitable for its intended use and free of signs of wear or dirt. The right of withdrawal cannot be exercised only for some parts of the product (e.g. accessories). The return of the Product to the Seller takes place under the Buyer's responsibility.

The Customer must return the product following the procedure below:

  1. send to support@macteovens.com the photo of the product to be returned, from all 4 sides;
  2. pack the product to be returned in its original packaging;
  3. send to support@macteovens.com the photo of the duly closed packaging, from all 4 sides;
  4. ship the product, duly packaged and protected, to the following address:

9.6. Refunds. In the event of withdrawal, the Seller will refund the Buyer the Total Amount Due, including shipping costs where incurred by the Buyer, with the exception of any additional costs resulting from the Buyer's possible choice of a type of delivery other than the least expensive type of standard delivery offered by us. The Seller will make the refund without undue delay and in any case within fourteen calendar days from the day on which it is informed of the Buyer's decision to withdraw from the contract. The Seller will make the refund of the Total Amount Due using the same means of payment used by the Buyer when placing the order, unless the latter has expressly agreed otherwise and provided that they do not have to bear any costs as a consequence of the refund. The Seller may withhold the refund until it has received the goods or until the Buyer has demonstrated that they have sent back the goods, whichever is earlier.

In the event that the Buyer exercises the right of withdrawal only for some of the products of an order for multiple products, the refund of the shipping costs initially incurred will be made proportionally in relation to the cost of each product. In any case, the refund may never exceed the amount actually paid by the user.

9.7. Non-compliant exercise of the right of withdrawal. In the event that the right of withdrawal is not exercised in accordance with the provisions of the law, it will not entail the termination of the contract and will therefore not give rise to any refund. The Seller will notify the Buyer of this within 10 working days from receipt of the Product, rejecting the withdrawal request. The Product, if it has already reached the Seller, will remain at the Seller's premises available to the Buyer for collection, which must take place at the expense and under the responsibility of the Buyer.

9.8. Diminished value of the returned Product. In the event of a diminished value of the Product due to handling of the products other than that necessary to establish their nature, characteristics and functioning, the amount to be refunded will be reduced by an amount equal to the diminished value. The Buyer will be informed of this by the Seller within 10 working days from receipt of the product. In the event that the refund has already been made, the Seller will provide the bank details for the payment due from the Buyer due to the diminished value of the Product.

9.9. Exclusion of the right of withdrawal. The right of withdrawal is excluded in the cases provided for by art. 59 of the Consumer Code. In particular, the right of withdrawal is excluded for clearly personalised products.
